By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

Please note that these Terms of Service may be translated into other languages for convenience. However, the English version is the legally binding version in the event of any discrepancies.

Introduction

PotatoHotDog is a site analytics service that provides website traffic insights with minimal setup and without requiring user accounts.

The Service is designed to be simple, privacy-respecting, and easy to integrate. These Terms describe your rights and responsibilities when using PotatoHotDog, as well as important limitations of liability.

Eligibility

Use of the Service is limited to individuals who are 16 years or older and legally able to form binding contracts in their country of residence.

By using the Service, you represent and warrant that you meet this requirement and are legally capable of entering into a binding agreement in your country of residence.

Discontinuation of Service

We reserve the right to discontinue or suspend the Service, in whole or in part, at any time and for any reason, including if maintaining it becomes commercially unviable.

If the Service is discontinued, we will attempt to provide reasonable notice in advance, but this cannot be guaranteed.

We are not liable for any loss, refund, or damages resulting from the discontinuation of the Service, even if users have paid for premium features.

Intellectual Property

All intellectual property rights in the Service, excluding data generated by users' own websites, are owned by or licensed to PotatoHotDog.

You may not copy, modify, distribute, reverse engineer, or create derivative works of the Service without our prior written permission.

Third-Party Services

The Service may include links to or integrations with third-party services or websites.

We do not control, endorse, or assume responsibility for any third-party services. Your use of such services is subject to their own terms and policies.

Changes to the Service

We may add, remove, or modify features, functionality, or technical behavior of the Service at any time, with or without notice.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Sweden, without regard to conflict-of-law principles.

Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Sweden, unless mandatory law provides otherwise.

Compliance with EU Regulations

PotatoHotDog operates from Sweden and follows applicable European Union laws and regulations related to analytics, tracking, and data protection.

Privacy-related matters are governed separately by the PotatoHotDog Privacy Policy.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

No Waiver

Failure by PotatoHotDog to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.

Payments and Premium Features

We may offer premium features that require payment.

By completing a purchase, you authorize us or our payment processor to charge your payment method for the applicable amount, and you acknowledge that all charges are final and non-refundable.

By purchasing any paid Service, you agree that:

You will provide accurate billing information and maintain valid payment methods.
We may change prices or discontinue premium features at our discretion.
Access to paid features may be revoked if you violate these Terms.

Prohibited Uses (Acceptable Use Policy)

You agree to use PotatoHotDog only for lawful purposes and in accordance with these Terms. You may not use (or attempt to use) the Service in any way that is illegal, harmful, abusive, deceptive, or that violates the rights of others.

PotatoHotDog may, in its sole discretion, restrict, suspend, or terminate access to the Service if it reasonably believes you have violated this section or that misuse is occurring.

Unlawful or harmful activity - Using the Service for any illegal activity, or to promote, facilitate, or encourage illegal activity.
Harassment and abuse - Harassing, threatening, bullying, stalking, defaming, or otherwise abusing any person or group.
Hate or extremist content - Generating or distributing content that promotes hatred, discrimination, or violence against protected groups, or that supports extremist ideologies or organizations.
Slurs and hateful or abusive language - Using racial, ethnic, religious, gender-based, sexual-orientation-based, disability-based, or other discriminatory slurs, or generating content whose primary purpose is hateful, demeaning, or abusive language toward others.
Violence, gore, or self-harm - Generating or sharing graphic violence, gore, or content that encourages self-harm or suicide.
Sexual content and pornography - Generating or distributing pornography, explicit sexual content, sexual exploitation content, or sexual content involving minors (which is strictly prohibited).
Non-consensual targeting or impersonation - Targeting, impersonating, or representing someone else without their consent, including generating content that imitates a real person's identity or voice without permission.
Privacy and personal data - Collecting, sharing, requesting, or generating personal data or personally identifiable information (PII) about others without consent (for example: addresses, phone numbers, private emails, government IDs, financial information, passwords, or precise location data).
Intellectual property and rights violations - Uploading, generating, or distributing content that infringes or misappropriates copyrights, trademarks, publicity/personality rights, privacy rights, or any other rights of a third party, or using the Service without the necessary permissions.
Fraud and deception - Using the Service to scam, phish, defraud, mislead, or manipulate others, including social engineering or creating deceptive communications intended to cause harm.
Security abuse / hacking - Attempting to probe, scan, test, bypass, or compromise the security of the Service, or any related systems or networks; attempting unauthorized access to accounts, data, infrastructure, or source code.
Circumventing safeguards - Circumventing technical limitations, rate limits, content filters, moderation systems, or access controls, or attempting to do so.
Disruption and misuse of resources - Interfering with, overloading, disrupting, or degrading the Service or its infrastructure (including through spam, excessive automation, abusive usage patterns, or denial-of-service behavior).
Malware and malicious content - Uploading, generating, or distributing malware, spyware, ransomware, viruses, or any other malicious code or instructions designed to cause harm.
Automated misuse: Using bots or automated methods to access the Service in a way that violates these Terms, abuses system resources, or attempts to manipulate metrics or usage limits.

You are responsible for ensuring that any content you upload, generate, or share through PotatoHotDog is lawful, respectful, and properly authorized, and for promptly stopping any use that could cause harm or violate these Terms.

Any violation of this Prohibited Uses section may result in immediate enforcement action, including restriction, suspension, or permanent and irrevocable account termination, which may occur without notice. For serious violations (including suspected illegal activity or threats to safety), PotatoHotDog may report matters to law enforcement and will cooperate with appropriate legal authorities and valid legal requests as required by law.

No Warranty

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory.

PotatoHotDog does not warrant that:

The Service will be uninterrupted, timely, secure, or error-free
Any outputs (including AI-generated text, audio, images, or video) will be accurate, complete, compliant, or suitable for any purpose
Data, files, or generated content will always be available, preserved, accurate, or complete
Any defects, bugs, or errors will be corrected
The Service will meet your specific requirements or expectations

Use of the Service is entirely at your own risk.

Limitation of Liability

To the fullest extent permitted by applicable law, PotatoHotDog shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of (or inability to use) the Service.

This includes, but is not limited to:

Loss of user uploaded or user generated data, files, models, prompts, or outputs
Loss of analytics history (if applicable), settings, or configuration
Loss of revenue, profits, business opportunities, or sponsorships
Business interruption or stream disruption
Loss of goodwill or reputational harm
Account enforcement actions by third parties (including content removal, strikes, suspensions, demonetization, or bans)
System failures, outages, service disruptions, delays, or performance issues

You acknowledge and agree that data may be lost, altered, delayed, corrupted, or permanently deleted, and that you are solely responsible for maintaining any backups, secondary systems, or alternative tools you require.

If, notwithstanding the foregoing, PotatoHotDog is found liable for any claim or damages, PotatoHotDog's total aggregate liability shall not exceed the total amount paid by you (if any) for the Service during the six (6) months immediately preceding the event giving rise to the claim.

Third-Party Platform Compliance (User Responsibility)

You are solely responsible for your use of PotatoHotDog and for any content, outputs, or actions produced through the Service, including all AI-generated text, audio, images, video, and automated actions.

You must follow platform rules - You are responsible for ensuring that your use of the Service and any content you generate, display, play, or broadcast complies with Twitch's Terms of Service and Community Guidelines, as well as the rules, policies, and terms of any other third-party platform or service you use.
Review before publishing - AI systems can produce unexpected or unwanted outputs. You are responsible for reviewing, moderating, and deciding whether to publish or stream any AI-generated content.
No guarantee of compliance - PotatoHotDog does not guarantee that any output will be compliant with Twitch rules (or any other third-party terms), even if safety measures or filters are in place.
You bear enforcement consequences - If your use of the Service or any AI-generated content violates a third-party platform's rules, you accept full responsibility for any resulting enforcement action (including content removal, strikes, suspensions, demonetization, or permanent bans).
No liability for third-party actions - To the maximum extent permitted by law, PotatoHotDog is not responsible or liable for any actions taken by third parties against you or your accounts arising from your use of the Service.
System failures, outages, service disruptions, delays, or performance issues

By using PotatoHotDog, you acknowledge that platform rules can change at any time and may be interpreted or enforced differently by third parties. You agree that you are responsible for staying up to date with the rules that apply to you, and for deciding whether and how to use AI-generated content on your stream or elsewhere.

Force Majeure

We are not responsible for delays or failures in performance due to causes beyond our reasonable control, including natural disasters, war, strikes, or internet disruptions.

AI Generated Content

Certain features and outputs provided by PotatoHotDog (including text, images, audio, video, and other media) may be generated or assisted by artificial intelligence ("AI Generated Content").

AI output is not guaranteed - AI Generated Content may be inaccurate, incomplete, misleading, offensive, or otherwise unwanted. You understand that AI systems can produce unexpected results even when safety measures and filters are in place.
Use at your own risk - You are solely responsible for how you use, publish, stream, share, or rely on AI Generated Content. You should review and validate outputs before using them on-stream or elsewhere.
No warranties - AI Generated Content is provided "as is" and "as available," without warranties of any kind, including (without limitation) warranties of accuracy, reliability, fitness for a particular purpose, non-infringement, or that outputs will be safe, error-free, or uninterrupted.
Your compliance obligations - You agree not to use AI Generated Content to violate any law or regulation, or to infringe or misappropriate any third-party rights (including copyright, trademarks, privacy, publicity/personality rights), or to create or distribute harmful, deceptive, or unlawful content.
Safety systems are not perfect - While we may implement moderation, filters, rate limits, and other safeguards, we do not guarantee that these measures will prevent all prohibited or harmful outputs.
Limitation of liability - To the maximum extent permitted by law, PotatoHotDog is not responsible or liable for any claims, damages, losses, costs, or other liabilities whatsoever arising from or related to AI Generated Content, including content generated using our LLMs, automation, or media generation features, even if we have been advised of the possibility of such damages.
Indemnity - You agree to indemnify and hold harmless PotatoHotDog and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of AI Generated Content, including any content you generate, publish, or distribute using the service.
Removal and enforcement - We may remove, restrict, or disable access to any AI Generated Content, prompts, accounts, or features at any time if we believe it violates these Terms, our policies, or applicable law, or if it poses risk to users, rights holders, or the platform.

If you believe AI Generated Content produced through the service violates your rights or is otherwise unlawful, please contact Support with relevant details so we can investigate and take appropriate action.

User Uploaded and User Generated Data Retention

This section applies only to data you upload to the service or data generated through the service for you (for example: voice samples, cloned voice models, TTS audio outputs, AI-generated text, images, video, prompts, settings, and other files or content). It does not apply to website traffic, analytics, logs, or similar data, which are covered in a separate section.

Inactivity-based deletion - We may delete user uploaded and user generated data that has not been accessed, used, downloaded, or updated for 6 months (or longer) after we determine it is inactive.
Permanent deletion - Deleted data is irreversibly removed and may not be recoverable.
No warranties - AI Generated Content is provided "as is" and "as available," without warranties of any kind, including (without limitation) warranties of accuracy, reliability, fitness for a particular purpose, non-infringement, or that outputs will be safe, error-free, or uninterrupted.
No retention guarantee - We do not guarantee storage of user uploaded or user generated data for any minimum period. You are responsible for keeping your own backups of anything you want to retain.
Operational and enforcement deletion - We may delete user uploaded or user generated data at any time due to maintenance, storage limits, policy enforcement, legal requirements, risk management, or other operational reasons.
Mistakes can happen - While we take reasonable steps to maintain the service, unintentional deletion or loss can occur due to human error, bugs, system failures, or third-party infrastructure issues.

To the maximum extent permitted by law, PotatoHotDog is not liable for any loss of user uploaded or user generated data, whether due to inactivity deletion or operational error.

AI Voice Cloning

PotatoHotDog may offer features that let you create, upload, train, or use synthetic voices ("Voice Cloning") for text-to-speech and related tools.

Rights & permission required - You may only upload, create, or use a cloned/synthetic voice if you have full legal rights to that voice and any recordings used to create it, or you have explicit permission from the voice's rights holder(s) (and the voice owner where applicable).
Your responsibility - You are solely responsible for the voices you upload or generate and for how you use them. You agree that your use of Voice Cloning will comply with all applicable laws and will not violate any third-party rights (including privacy, publicity/personality rights, and intellectual property rights).
No unauthorized or deceptive use - Do not clone, imitate, or generate any voice without permission, and do not use Voice Cloning to impersonate others, mislead listeners, or facilitate fraud, harassment, or other unlawful activity.
Immediate takedown: Any credible notice or evidence of unlawful, unauthorized, or unlicensed voice use may result in immediate removal of the voice/model and/or suspension of access, without prior notice.
Cooperation & enforcement - We may request verification of rights/permissions and may take any action we deem necessary to protect rights holders, users, and the platform.

If you are a rights holder (or authorized agent) and believe a voice is being used without permission, please contact Support with details that help us identify the voice/model and the basis of your claim. We will review reports promptly and may disable or remove access while investigating.

Feedback

If you submit feedback or suggestions, you grant us permission to use them without restriction or obligation to you.

Modifications to Terms

We may modify these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
